Terms & Conditions
1. Definitions
Company means Central Bay Electrical.
Client means the person or entity requesting services.
Work means all electrical services, installation, repairs, inspection, and supply of materials.
Site means the location where work is carried out.
2. Acceptance
2.1 These terms apply to all work carried out by the Company.
2.2 Acceptance occurs when the Client:

Approves a quote (verbally or in writing), or
-
Instructs work to begin
3. Pricing
3.1 All quotes are valid for 30 days unless stated otherwise.
3.2 Pricing may be fixed or charge-up (labour + materials).
3.3 Variations to agreed work will be charged in addition.
3.4 Unforeseen or hidden work may be charged where required.
3.5 All pricing is exclusive of GST
4. Payment Terms
4.1 Payment is due:

On completion for residential work unless otherwise agreed
-
Within 7 days for commercial clients unless agreed otherwise
4.2 Deposits and progress payments may be required.
4.3 Late payments may incur interest and recovery costs.
5. Ownership of Materials
5.1 Materials remain the property of the Company until paid in full.
6. Client Responsibilities
The Client must:

Provide safe and clear access to the Site
-
Ensure a safe working environment
-
Advise of any known hazards
-
Protect valuables and sensitive equipment
7. Health & Safety
7.1 Work will be carried out in accordance with New Zealand health and safety requirements.
7.2 The Company may stop work if conditions are unsafe.
7.3 Delays due to safety issues may be chargeable.
8. Compliance & Standards
8.1 All work will comply with applicable New Zealand electrical standards.
8.2 Certification will be provided where required.
9. Consumer Guarantees
9.1 Nothing in these terms overrides consumer rights where applicable.
9.2 For business clients, guarantees may be contracted out of where legally permitted.
10. Liability
10.1 The Company is not liable for:

Pre-existing faults or wiring issues
-
Failure of client-supplied equipment
-
Indirect or consequential loss
10.2 Liability is limited to the value of the work carried out.
11. Damage to Property
11.1 The Company will take reasonable care when carrying out work.
11.2 The Client acknowledges that electrical work may require cutting, drilling, or accessing concealed areas.
11.3 The Company is not liable for:

Minor or unavoidable damage
-
Damage to hidden or fragile structures not reasonably identifiable
11.4 Any damage caused by negligence will be remedied or covered by insurance where applicable.
12. Client-Supplied Materials
12.1 No warranty is provided on materials supplied by the Client.
12.2 Additional labour due to faulty or incorrect materials will be charged.
13. Access & Delays
13.1 Failure to provide access may result in a call-out fee.
13.2 Delays outside the Company’s control may incur additional costs.
14. Cancellations
14.1 Charges may apply for work completed, materials purchased, or late cancellations.
15. Warranties
15.1 Workmanship is warranted for 12 months.
15.2 Manufacturer warranties apply to supplied products.
16. Disputes
16.1 Any disputes must be raised within 7 days of invoice.
16.2 Both parties agree to attempt resolution before escalation.
17. Default
17.1 The Company may suspend work or recover costs for non-payment.
18. Privacy
18.1 Client information will only be used for business purposes unless required by law.
19. Force Majeure (Act of God)
19.1 The Company is not liable for delays or failure to perform due to events beyond its control, including:

Severe weather or storms
-
Flooding or earthquakes
-
Fire
-
Power outages
-
Supply chain disruptions
19.2 Additional costs arising from such events may be chargeable.
20. General
20.1 These terms may be updated at any time.
20.2 If any clause is invalid, the remainder remains enforceable.
20.3 These terms are governed by New Zealand law.
Specialised Electrical Clauses
21. Caravan, Motorhome & Marine Work
21.1 Work is carried out to applicable standards (e.g. AS/NZS 3001 where required).
21.2 The Company is not responsible for pre-existing faults or previous work.
21.3 Non-compliant installations will be identified and may require rectification.
21.4 Certification applies only to work performed unless otherwise stated.
21.5 Older installations may require upgrades to meet current standards.
22. Solar, Inverter & ELV Systems
22.1 Covers solar PV, batteries, inverters, and ELV systems.
22.2 No guarantee of system performance due to environmental factors.
22.3 No liability for compatibility issues with existing systems.
22.4 Client must ensure correct installation environment and use.
23. Electrical Inspections & Reports
23.1 Inspections are visual and non-invasive unless agreed.
23.2 Reports reflect condition at time of inspection only.
23.3 No liability for future faults or hidden defects.
23.4 Reports are not transferable without consent.
24. Contracting & Subcontract Work
24.1 Work is performed as per agreed scope.
24.2 The Company is not responsible for delays or damage caused by other trades.
24.3 Not liable for design faults where design is not provided by the Company.
24.4 Stand-down time and delays may be chargeable.
25. Certification
25.1 CoC, ESC, and ROI will be issued as required.
25.2 Certification applies only to completed work unless stated otherwise.
25.3 Additional documentation may incur charges.
26. Existing Installations
26.1 Pre-existing faults may exist.
26.2 The Company is not responsible for failure of existing systems.
26.3 Additional work required will be charged separately.
27. Isolation & Shutdowns
27.1 Power may be isolated to carry out work safely.
27.2 The Client must protect equipment and notify occupants.
27.3 No liability for reasonable shutdown-related loss.
28. Record of Inspection (ROI)
28.1 Applies only to inspected work.
28.2 Does not certify entire installations unless stated.
28.3 non-compliance must be rectified before issue.
29. Variations & Hidden Conditions
29.1 Hidden issues may be discovered during work.
29.2 These will be treated as variations and charged accordingly.
30. Privacy, Credit Information & Photographic Records
30.1 The Client authorises Central Bay Electrical to collect, use, and retain personal and business information for the purposes of:

Providing electrical services
-
Assessing and reviewing creditworthiness
-
Managing accounts and enforcing payment obligations
-
Compliance, record-keeping, and business operations
30.2 The Client consents to Central Bay Electrical obtaining information from third parties, including credit reporting agencies, trade referees, and debt collection agencies, for credit assessment and debt recovery purposes.
30.3 The Client agrees that Central Bay Electrical may disclose information to:

Credit reporting agencies for credit checks and monitoring
-
Debt collection agencies and legal representatives for recovery of overdue amounts
-
Any person or entity where required to enforce legal rights
30.4 The Client acknowledges that:
a) Information may be held by a credit reporting agency for credit reporting purposes;
b) If the Client defaults in payment, details of that default may be disclosed and shared with other users of the credit reporting system;
c) Credit monitoring services may be used to track changes in the Client’s credit profile;
30.5 The Client acknowledges that Central Bay Electrical may register a security interest under the Personal Property Securities Act 1999 (PPSA), and that relevant information may be disclosed on the Personal Property Securities Register (PPSR) and be publicly searchable.
30.6 The Client has the right to request access to, and correction of, any personal information held by Central Bay Electrical.
30.7 The Company may take photographs or videos of the Site, installations, and completed Work for the purposes of:

Compliance and certification records
-
Quality assurance and internal documentation
-
Training and staff development
-
Evidence of work completed
30.8 The Client acknowledges that such images may include areas of the Site where work has been carried out but will not intentionally capture personal or sensitive information.
30.9 The Company agrees that no identifying details of the Client, including names, addresses, or personal belongings, will be disclosed in any public use of images without the Client’s prior consent.
30.10 Photographs may be used for marketing purposes (including website, social media, and promotional material) only where the images are non-identifiable or where the Client has provided explicit consent.
30.11 All photographic and recorded materials remain the property of the Company and may be retained for business, legal, and compliance purposes.
30.12 All personal information will be collected, stored, and handled in accordance with the Privacy Act 2020.
31. Acceptance of Risk
31.1 The Client acknowledges that electrical work involving caravans, motorhomes, marine installations, solar systems, battery storage, inverters, and other mobile or off-grid systems carries inherent risks. These risks may include, but are not limited to:

Electrical faults or failures due to vibration, movement, or environmental conditions
-
System performance variations due to weather, shading, or usage patterns
-
Increased wear and tear compared to fixed installations
-
Limitations of existing or ageing equipment
31.2 The Client accepts that such systems may not perform to the same standard or reliability as fixed, grid-connected electrical installations and that ongoing maintenance is essential.
31.3 The Client is responsible for:

Ensuring the safe and correct operation of the system after completion
-
Carrying out regular inspections and maintenance
-
Using all equipment in accordance with manufacturer instructions
-
Monitoring system performance and arranging repairs where necessary
31.4 The Company is not liable for:
-
Failures, faults, or damage occurring after completion due to normal use, environmental conditions, or lack of maintenance
-
Issues arising from modifications, alterations, or repairs carried out by others
-
Pre-existing faults or limitations in the installation or equipment
-
Any indirect or consequential loss resulting from system failure
31.5 Where the Company provides advice, recommendations, or system design, this is based on information available at the time and does not guarantee specific performance outcomes.
31.6 The Client acknowledges that modifications to existing systems may expose previously unknown faults or weaknesses, and accepts responsibility for the cost of any additional work required to address such issues.
32. Non-Payment & Debt Recovery Costs
32.1 If any invoice remains unpaid beyond the due date, the Company reserves the right to:

Suspend or cease all work
-
Refer the outstanding balance to a debt collection agency
32.2 The Client agrees that all costs incurred by the Company in recovering overdue amounts shall be recoverable from the Client. This includes, but is not limited to:
-
Debt collection agency fees
-
Legal costs (on a solicitor-client basis)
-
Court filing fees
-
Administration and recovery costs
32.3 The Client acknowledges that debt collection costs may be calculated as a percentage of the outstanding debt and agrees to pay such costs in full.
32.4 Interest may be charged on overdue amounts at a rate of up to 5% per month, calculated daily, from the due date until payment is made in full.
32.5 Any payments received may be allocated at the Company’s discretion to outstanding invoices, fees, interest, or costs.
